A thorough estate plan allows you to create a map of how you want your current situation handled and can direct others to carry out your wishes in case you become incapacitated and how you would address your family or loved ones after your death
The goal is for you to make the decisions about your lifetime concerns and your wishes to take care of your family after you pass and not have a court decide who will manage your finances and decide who makes your health care decisions. In California, the probate process can be expensive, open to the public and ultimately a judge will decide how your assets are handled and distributed to your family.
To avoid the probate process, you should have a Revocable Living Trust which includes a durable power of attorney, advanced health care directives and a living willthat addresses who can make your health care decisions if you are unable to make such on your own.
